Comments & Photographs Policy
Photograph Submission and Restoration Terms
If you are planning to send or drop off a photograph for restoration, the following terms apply:
Limitations of Liability:
Photo Fantastic shall not be liable for any compensation regarding time spent on the restoration, nor for any costs related to the reposting or return of submitted items.
1. Formation of Contract
By commissioning Photo Fantastic Restorations to carry out photographic restoration work, you agree to enter into a binding contract upon your acceptance of the proposed work and associated costs. This acceptance may be verbal, written, or via electronic communication.
2. Commencement of Work
Work on your restoration project will commence only after acceptance has been confirmed. Once work has begun, the contract is considered in full effect and you will be liable for the agreed-upon charges.
3. Cancellation and Amendments
You may cancel or request changes to the restoration work only prior to the commencement of work.
Once work has started, cancellations may not be accepted, and you may be charged in full or in part, depending on the progress made.
4. Turnaround Time
Typical turnaround time is up to one week from the date of commencement. However, this may vary depending on the number of photographs submitted and the extent of damage requiring repair. Any estimated completion date provided is indicative only and not guaranteed.
5. Payment Terms
Payment is due upon completion of the restoration work. You will receive a final invoice once your restored images are ready for delivery. Full payment must be made before any digital files are released or original materials are returned.
5.1 Non-Payment Clause:
If, after reasonable attempts, the restoration cannot be corrected to your satisfaction, no payment will be required. In such cases, the original photograph(s) will be returned to you.
6. Digital Delivery
Restored images will be delivered in digital format, typically via email or secure download link, unless otherwise agreed. You are responsible for ensuring your email address or preferred delivery method is accurate and accessible.
Please note: Colours and tones in Digital photographs may appear differently depending on your monitor or display device. Colour representation can vary significantly between different screens and systems. Photo Fantastic Restorations uses Spyder colour calibration software to tune displays to Adobe standard colour profiles for consistent and professional results. However, exact colour matching on client devices cannot be guaranteed.
7. Return of Original Materials
Original photographs or physical media supplied by you will be returned upon completion of the restoration work, using standard postal services or a method agreed upon at the time of acceptance.
Photo Fantastic Restorations is not liable for any loss or damage to original items once they have been dispatched.
8. Client Responsibility
It is the client’s responsibility to review and confirm the restoration details, including expected outcomes and cost, prior to acceptance. Any significant changes requested after acceptance may be subject to additional charges.
9. Liability
While every effort is made to handle your original materials with care, Photo Fantastic Restorations accepts no liability for loss or damage arising from pre-existing defects, deterioration, or third-party handling, including postal or courier services.
Media Usage
If you send digital photographs or images to Photo Fantastic Restorations, we may use them to showcase our work, including before-and-after comparisons. If you do not wish for your images to be featured, please inform us at the time of hire.
If you change your mind later, you may request removal by providing written notice or an email. We will take down the image within 14 days of acknowledgment without any financial liability or legal action against Photo Fantastic Restorations.
Safe Handling of Your Photographs
If you deliver physical photographs to our premises, we take due care in handling them. However, if your images are in frames or under broken glass, they need to be removed for restoration. We recommend removing them beforehand.
If you permit us to remove your photographs from frames, we cannot be held responsible for any additional damage during the process. This includes removing backing materials, screws, nails, staples, or fragile cardboard frames.
For those who prefer a non-invasive approach, photographic reproduction instead of scanning is available at an additional cost.
Copyright Policy
We respect copyright laws. Professional photographs are protected and require the photographer’s consent for reproduction, typically for a fee. Unauthorized use may result in legal action.
By submitting images to us, you confirm that no copyright is being infringed. Photo Fantastic Restorations is not responsible for any copyright violations, and you assume full liability for any claims that may arise.
Letters & Correspondence
All written correspondence is securely shredded after order completion, unless retained for legal purposes.
By leaving a comment on our website, you grant Photo Fantastic Restorations the right to display it publicly. Your comments may be visible to anyone visiting the site.
Privacy & Image Storage
- Customer details are strictly confidential and are never sold to third parties.
- By using our services, you allow us to feature your images for promotional purposes, unless you opt out in writing.
- Names are not disclosed to maintain confidentiality.
- Images are archived for 30 days in case further reworking or reprints are needed. After this period, retrieval incurs a £10 GBP fee. Images are permanently deleted after 40 days.
Under the Protection of Children Act 1978 and Criminal Justice Act 1988, it is illegal to:
- Possess or download indecent images of children
- Distribute, share, or forward such content (even if received unsolicited)
- Create or manipulate images, including deepfakes or pseudo-imagery. Any indecent material sent to Photo Fantastic Restorations will be sent for investigation by the Police authorities.
Contact Forms & Data Security
- Information submitted via contact forms is sent to our email system and stored for administrative and legal purposes.
- Payments are securely processed through Zettle by PayPal. Their privacy policy can be found Zettle is a PCI certified company.
- To prevent spam, we use reCAPTCHA v2, which is subject to Google’s Privacy Policy and Terms of Use.
